Medtronic seeks a highly qualified trademark counsel to join our IP team.  You'll manage trademark and copyright matters for multiple Medtronic operating units, and you will interact directly with business teams on product launches, including the protection of brands, trademarks, copyrights and domain names. This position reports to the IP Director, TM.

A Day in the Life

Responsibilities may include the following and other duties may be assigned.

  • Managing a global trademark portfolio 
  • Handle trademark disputes, including preparing cease and desist letters and other correspondence relating to IP infringements, manage oppositions and cancellations; can successfully negotiate resolutions of disputes; draft settlement agreements  
  • Manage outside counsel handling TTAB proceedings and litigations and assist with anticounterfeit cases. 
  • Review and analysis of global trademark searches for clearance of use on products 
  • Draft and review licensing and other agreements, as needed, to support business operations 
  • Develop strategic relationships with operating unit marketing teams and enterprise branding and communication teams, and educate them on trademark and copyright basics 
  • Manage outside counsel to accomplish key deliverables on time and on budget 
  • Manage, implement and coordinate strategy that deals aggressively and systematically to protect the company’s core brand identity throughout the world 
  • Work with customs authorities, law enforcement agencies and legal representatives throughout the world to prevent the sale of counterfeit and copycat product, both online and offline 
  • Support and advise on trademark and copyright issues that may arise in M&A due diligence 
  • Model the Medtronic Mindset – acts boldly; competes to win; moves with speed and decisiveness; fosters belonging; and delivers results the right way 
Must Have: Minimum Requirements
  • J.D.
  • 5 years of experience in trademark and copyright law
  • Licensed member in good standing to practice in at least one state
Nice to Have
  • Prior litigation and/or in-house experience 
  • Ability to effectively translate IP issues to members of the creative, marketing, business, management and legal teams 
  • Creativity, attention to detail, commitment to customer service and excellent communication skills 
  • Strong multi-tasking skills and the ability to prioritize effectively to meet deadlines 
  • Able to thrive in ambiguity and make decisions amidst multiple, competing demands and activities  
  • A proactive partner with a pragmatic, solutions-oriented, and curious mindset 
  • Working knowledge of PowerPoint, Excel and Word applications
